Scope and contact
These terms govern berthlab.txyou.com and its optional publishing service, operated by TXYOU, LLC. Contact berthlab@txyou.com. Effective date: September 29, 2026. The iOS app is distributed by Apple and is subject to the applicable App Store terms and Apple’s Standard Licensed Application End User License Agreement, unless a separate applicable EULA is supplied in the listing. These website terms do not replace Apple’s purchase terms.
Simulation, not instruction or navigation
BerthLab is a conceptual low-speed boat-handling simulator. Its lessons, scores, videos and review notes are not boating qualifications, real-world safety assessments, professional advice, charts, weather forecasts or navigation tools. Vessel dimensions and response coefficients may be approximations. No manufacturer endorsement, sea-trial calibration or ability to operate a real vessel is implied. Obtain suitable practical instruction and follow applicable rules and conditions for actual boating.
Availability and purchases
Core practice and optional paid capabilities are described in the app and its current App Store listing. The website does not process app purchases. Displayed Apple prices and availability govern; we do not promise a fixed worldwide price. Restore eligible purchases using the same Apple account and the app’s restore control. Apple manages refund requests under its applicable policies. The website does not grant paid app entitlements.
Your uploads and limited license
Upload only your own BerthLab session material that you have the right to share. By consenting to publication, you grant us a non-exclusive, worldwide, royalty-free license to store, process, format, display and distribute that upload and its derived captions and review notes for the publishing service. Separate search-visibility consent permits inclusion in our tutorial channel and sitemaps. This is not a transfer of ownership. Withdrawal ends future public display by us, subject to necessary technical deletion processing and any legal retention; it cannot recall copies others have already made.
Content rules and moderation
Do not submit personal information about others, unlawful or infringing material, hate, harassment, sexual content, deceptive claims, malware, advertising spam or dangerous real-world instructions disguised as certified training. Do not fabricate endorsements or represent a schematic simulation as real footage. We review uploads before publication and may refuse, remove or restrict content and block abusive publishers. Report a video using its report control or email support; include the public page address, not another person’s private management token.
Management links and eligibility
Publishing is optional, has no user account and is intended for people aged 16 or older. Keep your private management link secure; possession authorizes management and deletion of the associated upload. You are responsible for what you choose to publish. We may require evidence of ownership for support-assisted deletion when the link has been lost. Normal app practice does not require consent to public publishing.
Service limits and responsibility
We may set upload limits, change or discontinue the publishing service and remove unsupported or abusive content. We do not guarantee uninterrupted operation, permanent storage, search ranking or inclusion in AI-generated answers. Keep your own copy of material you need. To the extent permitted by applicable law, the service is provided as available without additional warranties; nothing in these terms excludes liability or rights that cannot lawfully be excluded. Mandatory consumer rights remain unaffected.
Disputes and changes
Contact us first so that we can try to resolve a concern. These terms do not deprive consumers of mandatory protections or access to competent courts under applicable law. Material changes will be posted with an updated effective date and additional consent requested where required. Apple is not the operator of this website or responsible for its content moderation.
